Protecting Children: Review of section 12 of the Children and Young Persons (Scotland) Act 1937 and section 42 of the sexual offences (Scotland) Act 2009

Our Policy Intern, Jack Draper, has summarised those aspects of the consultation which refer to or are most likely to have an impact on sport. While we've attached the full list of questions within the consultation for your reference, the two which most likely relate to sport are detailed below.

While the consultation closed on 14th November, we have been granted an extension until 10 December to gather input from our members in this area. We are also in discussion with sportscotland and Safeguarding in Sport about responding to this consultation.

  • Question 19 – Do you have any comments on whether the definition of a ‘position of trust’ should be extended to cover other positions in which a person is in a position of power, responsibility or influence over a child?
  • Question 20 – Do you have any other comments on the ‘sexual abuse of trust’ offence at sections 42-45 of the Sexual Offences (Scotland) Act 2009?
